The garnishment table is an overview that indicates the maximum amount of money that can be seized in the event of a wage or salary garnishment, pension benefits or other benefits. The table is based on legal requirements and is updated regularly. Overall, the seizure table is intended to ensure that a debtor still has enough money to live on even after a seizure or during bankruptcy and is not completely financially ruined.


According to this table, most people usually have significantly more money available after filing for bankruptcy than before. This is because after the application has been submitted by a suitable person or body according to Section 305 InsO (e.g. SIC SCHULDNER-INSOLVENZ-CENTRUM eV) by a debtor and insolvency advice center, creditor preferential treatment and creditor disadvantage may no longer take place. In concrete terms, this means that no more installment payments, loans or debts may be paid.


The current seizure exemption amount (since July 1, 2023) amounts to 1,409.99 euros.

Since July 1, 2023, the seizure exemption amount has been 1,409.99 euros. Even in the event of bankruptcy, you always have at least 1,409.99 euros per month! in the account from net income for free disposal.


However, if a debtor has to pay maintenance or grants maintenance in kind (children under 25 who live at home and have no fixed income) to children or his wife, he has an even higher seizure allowance*. The increase amount for the first maintenance obligation was also increased from to 527.76 euros* on July 1st. New seizure-free amounts for checking accounts from July 2023

As of July 1st, the increase amount for the first maintenance obligation will be increased from the current 500.62 euros to 527.76 euros. A total of an impressive 1,939.99 euros cannot be seized. Example calculations for the seizure allowance on the P account.

For singles, married people without children and married people with children


1. Sample calculation of the allowance - case 1: single person.

A single person has a net income of €1,500. In this case, the creditor can seize €68.40 per month! The person is left with €1,431.60.

For example, if this person has debts of €80,000, with a net income of €1,500 per month, only €68.40 per month will be seized during a 3-year bankruptcy. So after three years you are completely debt-free by only paying back €2,462.40 instead of the entire debt! The person saves a total of €77,537.60!


2. Example calculation of allowance - case 2: A married person WITHOUT children.

A married person without children has a net income of €1,980.00. According to the seizure table, €24.98 will be seized. This leaves the person with €1,955.02!


3. Example calculation of the allowance - case 3: A married person with a child:

A married person with one child has a net income of €2,300.00. Only €30.38 of this will be seized!

For example, if this person has debts of €47,000, with a net income of €2,300.00 per month, only €30.38 per month will be seized during a 3-year bankruptcy. So after three years you are completely debt-free by only paying back €1,093.68 instead of the entire debt! The person saves a total of €45,906.32!

All earnings in this category cannot be seized in their entirety and therefore do not have to be taken into account when looking at the garnishment table.

Compensation for overtime


Overtime pay will not be garnished in full. Deduct 50% of the overtime pay before calculating the garnishable amount using the garnishment table. Only half of this can be seized.


Christmas bonus


When it comes to Christmas bonuses, special conditions apply in the event of a seizure. This is regulated by Section 850a No. 4 ZPO. Up to half of the monthly wage cannot be seized. You can keep the other half. However, there is a maximum amount of €500.00 that you can keep.


Holiday pay


Holiday pay cannot be seized. So you don't have to take it into account when you calculate the seizable amount using the garnishment table

  • What is the basic allowance?

    The basic allowance is the amount up to which a debtor's income cannot be seized in the event of insolvency. In 2023, the basic allowance is currently 1,265.00 euros per month.

  • What is the seizure exemption amount?

    The seizure allowance is the amount that a debtor is allowed to keep in insolvency in order to secure his or her livelihood. In contrast to the basic allowance, the seizure allowance depends on the number of dependents.

  • How is the seizure exemption amount calculated?

    The seizure exemption amount is calculated based on the seizure table.

  • What happens if a debtor's income exceeds the seizure allowance?

    If a debtor's income exceeds the seizure exemption amount, the creditor may seize the amount that exceeds the exemption amount.

  • Can the basic allowance or the seizure allowance be challenged?

    The basic allowance is set by law and cannot be challenged. The seizure exemption, however, can be challenged in certain cases.
