Our board member Wolfgang Seelig was insolvent himself and knows how difficult it can be to find competent debt counseling and help. In the end, together with a lawyer and with a lot of personal work, he managed to get out of debt. This experience led him to become a volunteer debt counselor in 2007.
After successfully completing a course to become a state-approved debtor and insolvency advisor, he founded his own advice center. The offer can now be used at 14 locations throughout Baden-Württemberg. Customers receive a free initial consultation at eye level and the guarantee of becoming debt-free within three years in accordance with the statutory provisions.
The insolvency code distinguishes between the standard insolvency for entrepreneurs and the simplified personal insolvency procedure. Both go through the phases of insolvency application, opening procedure, opening of insolvency, court date (creditors' meeting) and examination date. In the subsequent liquidation phase, the insolvency administrator (or, in the simplified procedure, the trustee) implements the resolutions of the creditors' meeting. He realizes the assets and distributes them to the individual creditors, taking into account the garnishment table.
After the realization and examination, the insolvency administrator submits a final report to the court. At the closing date, the insolvency court approves the final distribution and cancels the insolvency proceedings after the assets have been distributed. In the case of legal entities, insolvency is then over. In the case of proceedings concerning the assets of natural persons, the three-year phase of good conduct follows. If there are no grounds for refusal, the court announces by resolution that the residual debt will be discharged, provided that all legal obligations are met.
After the end of the good conduct phase, the court decides whether the final discharge of residual debt is granted. To this end, debtors, trustees and insolvency creditors are consulted.
