A bankruptcy proceeding is (put simply) a judicial procedure that a debtor can apply for if they are experiencing persistent financial problems. Upon request, a procedure is opened at the competent district court, which includes all obligations, but also all assets, and discharges the debt with the help of an administrator appointed by the court. This procedure is associated with conditions and participation, but ultimately results in "debt relief" so that a financial start is possible for the person concerned. We will be happy to explain the possibilities and limits in detail in the free initial consultation.
Generally, yes. However, there must be a financial situation that justifies such a procedure, ie current income and existing assets are no longer sufficient to meet payment obligations (overindebtedness). The debt must also be higher than the legal costs. An unpaid fitness membership alone usually does not fulfill this situation.
Yes. On the one hand the consumer insolvency proceedings and on the other hand the standard insolvency proceedings. Both procedures are identical in that both have a debt relief, the debt relief to the content.
It is regulated by law that an application for consumer insolvency must always be preceded by an attempt to reach an out-of-court (pre-)court agreement with all creditors by a recognized insolvency advice center. This means that he has to try to come to an agreement with all creditors. The basis of the debt settlement plan to be developed is the attachable income and the debtor's assets, possibly supplemented by voluntary payment amounts.
If the application for consumer bankruptcy, supplemented by the applications for discharge of residual debt and deferral of the procedural costs, has been submitted to the court, the first step is to check whether all the information and attachments are complete. The insolvency judge will then decide on the opening of the proceedings (in the "normal case" a so-called opening decision will be made).
Yes. In insolvency proceedings, there are costs on the part of the court (court, procedural costs) and costs for the administrator / trustee. As a precaution, an application for deferral of costs should be made if the insolvency estate is not sufficient to pay these costs.
